Fox News legal analyst Gregg Jarrett joined ‘FOX and Friends’ Wednesday morning to discuss New York Judge Juan Merchan partially lifting the gag order against Donald Trump who can now publicly comment about witnesses and jury generally, but is restricted from sharing personal information about court staff and individual jurors.
The ruling is yet another “warped and senseless ruling” by Judge Merchan, Jarrett said. The gag order, which was an unconstitutional restriction of speech, should have been lifted weeks ago when the trial ended and jurors were dismissed, he added. The fact that the gag order wasn’t lifted then, “underscores…the unfair treatment of Donald Trump,” Jarrett argued, noting that nothing changed to lift part of the gag order on the day Judge Merchan decided to do it.
The fact that the New York Appellate Court said that there is “no substantial constitutional question” regarding this is outrageous, Jarrett suggested, noting that silencing a presidential candidate violates not only Trump’s First Amendment right, but the rights of Americans to hear his speech as well.
